(Consumers are any natural persons who conclude a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.)

Cancellation Policy

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day:

  • you or a third party named by you, who is not the carrier, have taken possession of the goods, if you ordered one or more items as part of a single order and the goods are delivered together;

  • you or a third party named by you, who is not the carrier, have taken possession of the last item, if you ordered several items as part of a single order and these are delivered separately.

To exercise your right of withdrawal, you must inform us (Ehret & Müller GbR, Sendelbachstraße 10, 96148 Baunach, Germany, Phone: +49 163 4702548, Email: support@devaque.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for additional costs arising from your choice of a different type of delivery than the standard, least expensive one offered by us), without undue delay and at the latest within 14 days from the day on which we receive the notice of your withdrawal from this contract.

We will use the same payment method for this reimbursement as you used for the original transaction unless expressly agreed otherwise; in no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without delay and in any event no later than 14 days from the day you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We kindly ask you to try on items only for fitting purposes and not to leave any signs of use. In case of damage or excessive wear, we reserve the right to charge compensation. For items with removed hangtags or signs of use beyond regular trying on (e.g., stains, odors, stretching, damage), the refund may be reduced accordingly.

Exclusion or Early Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is essential or which are clearly tailored to the consumer’s personal needs;

  • for the delivery of goods that can spoil quickly or whose expiration date would soon be exceeded;

  • for the delivery of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market beyond the control of the seller;

  • for the delivery of newspapers, magazines, or periodicals except for subscription contracts.

The right of withdrawal expires early for contracts:

  • for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;

  • for the delivery of goods which, after delivery, are inseparably mixed with other goods due to their nature;

  • for the delivery of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
